Julia’s House Gameathon (October 2020)

By taking part in the Julia’s House Gameathon, each partcipant agrees to these terms and conditons.

1. GENERAL
  1. 1.1.  These terms and conditons (Terms) apply to all events organised for the benefit of Julia’s House – The Dorset & Wiltshire Children’s Hospice (each an Event) and by registering for an Event, you agree to comply with them.

  2. 1.2.  Julia’s House Limited is a registered charity with its registered office address at Barclays House, 1 Wimborne Road, Poole, BH15 2BB (Julia’s House). Registered Charity No. 1067125.

  3. 1.3.  If you have any questons please contact the manager of the event on 01202 644220 or email info@juliashouse.org and a member of the team will be happy to help you.

  4. 1.4.  For the purposes of these Terms, references to “you” mean the individual registering for an Event and “your” shall be construed accordingly.

2. PARTICIPANT ENTRY

2.1. In order to participate in an Event you must complete a registration form. Visit: juliashouse.org/Gameathon

3. Participants are fully responsible for their ac9ons while taking part in the Julia’s House Gameathon event. We do not accept responsibility for the ac9ons of the participant, nor the consequences of such ac9ons.

  1. 3.1.  If you are aged under 18 years you must get permission to take part from your parent or guardian before registering. Under 18s should have supervision whilst participatng in the gaming event and should play age appropriate games.

  2. 3.2.  Julia’s House reserve the right at any 9me (whether before or acer you have registered for an Event), without liability, to refuse participation to you or any other participant without providing a reason.

  3. 3.3.  The Event runs 23 May- 24 May 2020.

  4. 3.4.  Julia’s House is not responsible for the type or content of games participants choose to play as part of the Gameathon event and whether they are age appropriate. Responsibility sits with the participant and/or participants parent or guardian.

4. CHANGES, CANCELLATIONS AND LAST MINUTE ARRANGEMENTS

4.1. Julia’s House reserve the right to cancel or postpone an Event at any 9me for any reason without prior notice. Where and if possible, we will endeavour to re-arrange the Event for a new date.

5. CONDUCT
  1. 5.1.  You are fully responsible for your ac9ons whilst taking part in an Event. Julia’s House do not accept responsibility for your ac9ons, nor the consequences of such ac9ons.

  2. 5.2.  You shall, and shall procure your supporters shall, abide by the rules and any rules, instructions or regulations displayed or given on the day of the Event.

  3. 5.3.  Julia’s House respectfully asks that you and your supporters do not use aggressive or abusive language whilst taking part in the Event. You should also avoid behaving in a way which may cause injury or harm to yourself or other participants, or which may cause offence or damage the reputation of Julia’s House.

6. HEALTH AND SAFETY AND MEDICAL
  1. 6.1.  You must be confident that you are physically and mentally capable of participating in the Event. If you are at all unsure about this, you should seek medical advice from your GP before the Event.

  2. 6.2.  Julia’s House may also ask you to withdraw during an Event if it has concerns about your ability to complete it due to fitness, injury or otherwise. If you choose to continue you do so with the understanding that you absolve Julia’s House of all and any responsibility, and progress entirely at your own risk.

7. USE OF FILM AND PHOTOS AT/ AFTER EVENTS
  1. 7.1.  Julia’s House may use photography or filming that you share on your social media channels where you tag Julia’s House. Photos and film may be used in our publications, promotion, advertising and social media channels. By tagging Julia’s House via social media channels you are consenting to your photography and film being used by Julia’s House.

  2. 7.2.  If you are under 18 and share your photos and/or film with Julia’s House by tagging on social media, we will assume that parent or guardian permission has been given.

8. SPONSORSHIP MONEY AND DONATIONS
  1. 8.1.  You have a legal responsibility to ensure that all sponsorship monies/donations received in connection with an Event are paid to Julia’s House, and that you do this as soon as possible acer the Event. Money pledged via online fundraising pages is collected automatically. For the Julia’s House Gameathon sponsorship/ fundraising should be collected via JustGiving.

  2. 8.2.  Gic Aid can be claimed on donations made via JustGiving.

  1. 8.3.  You agree that you will use your best endeavours to raise money for Julia’s House in connection with your participation in the Julia’s House Gameathon. Any fundraising undertaken in connection with the Julia’s House Gameathon will be for Julia’s House, the Dorset and Wiltshire Children’s Hospices.

  2. 8.4.  Fundraising on JustGiving may only be conducted by users over the age of 18. Julia’s House Gameathon participants under 18 wishing to fundraise will need a parent or someone 18 years or over to setup a fundraising page for you on JustGiving. 9. USE OF PERSONAL DATA
  1. 9.1.  By providing personal data when you register for an Event, you confirm that you consent to such data being used by Julia’s House for the purposes of organising, staging and administering the Event. If you provide personal data on behalf of additional entrants, you also confirm that you have obtained their consent for such data to be used for the same purposes.

  2. 9.2.  Your personal information may also be used for the purposes of sending communications to you where you have confirmed that you would like to receive further information about the charity’s work when registering for an Event.

  3. 9.3.  All personal data held by Julia’s House will be handled in accordance with the terms of the Data Protection Act 1998 and in accordance with Julia’s House’s privacy statement which can be found at www.juliashouse.org/privacy.

10. LIABILITY
  1. 10.1.  Use of the Julia’s House website is subject to the Julia’s House website terms and conditions.

  2. 10.2.  You enter and participate in an Event en9rely at your own risk. Julia’s House shall not be liable for any injury, damage or loss to you or your property that might occur as a result of your participation or attendance at an Event, other than in respect of any injury or loss arising as a result of their negligence. For the avoidance of doubt, nothing in this paragraph shall exclude or limit liability for any liability that cannot be excluded or limited by law.

11. PRIZES
  1. 11.1.  There will be a prize draw for all Gameathon participants who raises over £50 (excluding Gift Aid) for Julia’s House by participating in the Event. To qualify for the prize draw, participants must have signed up to the Gameathon event via the Julia’s House website juliashouse.org/JHgameathon and have raised money for the Event through JustGiving.
     
  2. 11.2.  The prize draw will close at 10am on Tuesday 3rd November 2020. The winner will be selected at random and announced by 5pm on Tuesday 3rd November 2020. The winner will be contacted via email or phone based on the contact details provided when the Participant signed up for the Event. We will also announce the winner on our website and social media channels (first name only of the winner will be used).
     
  3. 11.3.  The Charity will review all JustGiving fundraising pages of Participants for the Gameathon event to determine fundraising amounts raised at the time/date of prize draw close. All participants who have raised over £50 (excluding Gift Aid) will be automatically entered into a prize draw, selected at random.
     
  4. 11.4.  The Charity will aim to dispatch, by post, the prize to the winning participant within 28 days of Tuesday 3rd November 2020. Due to the current circumstances with Covid 19, the prize distribution may be delayed due to circumstances beyond our control.
     
  5. 11.5.  The Charity accepts no responsibility for the prize being lost, damaged or delayed in the post.
     
  6. 11.6.  The prize is non-exchangeable, non-transferable and no cash alternative is offered.
     
  7. 11.7.  The Charity reserves the right to replace the prize with an alternative prize of equal value if circumstances beyond the Charity’s control makes it necessary to do so.
     
  8. 11.8.  The prizes have been donated to the Charity.
     
  9. 11.9.  Participants are deemed to have accepted and agree to be bound by these Terms and Conditions upon entry. The Charity reserves the right to refuse to award the prize to anyone in breach of these Terms & Conditions.
     
  10.   11.10.  The Charity reserves the right to hold void, cancel, suspend or amend the Promotion or these Terms and  Conditions where it becomes necessary to do so.
     
  11.   11.11.  Personal data supplied during the course of this Event will be used for the purpose of sending out the top winning prize to the winning Participant.   12.   11.12.  The Promotion, these Terms and Conditions, and any dispute or claim between the parties arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales. Each party irrevocably agrees that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with the Promotion and / or these Terms and Conditions, or their subject matter or formation.
